Ultimately, Phineas' allegiance is to Justicia, of course. If I had to choose, though, it feels more appropriate for him to be on the side of the Aristocracy since they have the de jure claim to the land. Having said that, he could certainly have been conscripted into Emil's army, too. Since it isn't clear yet whether or not the party plans to continue in Emil's service, I think it makes sense for Phineas to either be a conscript, or an independent party. Maybe he has just arrived in the region? Or maybe he has been conscripted and was sent out on an earlier patrol that the party passes on the road?
I think that is a good idea, regardless of which side of the fray Phineas is on, to have some idea of where he is from. I am happy to work on that with you. Your mention of a Theocracy brought Vatican City to mind. Perhaps a Theocratic city-state that remains sovereign and apart from other nations because they are recognized as international mediators?
